For those who already possess a basic understanding of copyright law, this workshop takes a closer look at the fair use defense and The TEACH Act. The workshop offers insight into what current cases and research reveals about how courts really evaluate the fair use factors when confronted with actual cases. While educators like to focus on their non-profit educational role (the first factor), this sometimes conflicts with the impact on the market for the work (the fourth factor). In addition to examining the tension between these factors, the 9th Circuit’s decision in Perfect 10 v. Amazon.com & Google.com will be discussed.
